Welcome to NeutralPassageWay ("we," "our," or "us"). These Terms & Conditions ("Terms") oversee your use of our yacht charter services and website located at neutralpassageway.sbs (the "Service") managed by NeutralPassageWay.
By securing a charter or utilizing our Service, you consent to abide by these Terms. If you do not concur with any part of these terms, then you should not use the Service.
2. Service Overview
NeutralPassageWay offers luxury yacht chartering services that encompass:
- Daily yacht rentals
- Sunset excursions
- Corporate getaways
- Exclusive gatherings
- Extended charters
All offerings are dependent on availability and favorable weather. We retain the right to adjust or cease services without prior notice.
3. Booking and Reservations
3.1 Booking Process
To reserve a charter, you are required to:
- Be at least 18 years old
- Supply valid and complete details
- Make a payment for the necessary deposit as outlined in your reservation confirmation
- Accept these Terms & Conditions
3.2 Confirmation
A booking is deemed confirmed only after receiving your payment and a confirmation message from us. We hold the right to deny service at our discretion.
3.3 Availability
Charter availability is subject to the accessibility of vessels and appropriate weather. We aim to fulfill your requested dates and times as feasibly as possible.
4. Payment Terms
4.1 Pricing
All fees are stated in € and incorporate relevant taxes unless specified otherwise. Prices are subject to modification with no prior notification.
4.2 Payment Schedule
- Deposit: 50% of the total cost of the charter due at the time of reservation
- Remainder: Payable 48 hours before the departure of the charter
- Extra fees (if applicable): Settled upon the conclusion of the charter
4.3 Payment Methods
We accept principal credit cards, electronic bank transfers, and certified bank drafts. Payment processing is conducted using secure, encrypted platforms.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- Over 72 hours before departure: Complete refund minus transaction fees
- 24-72 hours before departure: Refund of 50%
- Under 24 hours before departure: Non-refundable
5.2 Weather Cancellations
If our captain deems weather conditions to be unsafe, we will propose to:
- Reschedule the charter to another suitable date at no extra cost
- Issue a full refund if rescheduling is unfeasible
5.3 Mechanical Issues
If mechanical difficulties occur with the assigned vessel, we will endeavour to provide an adequate substitute. If a replacement is unavailable, we will issue a full refund.
6. Safety and Conduct
6.1 Safety Requirements
Every passenger must:
- Adhere to all instructions given by the crew
- Utilize the provided safety gear when necessitated
- Inform us of any health conditions that could impinge on their safety
- Stay within designated sections of the yacht
6.2 Prohibited Items
Certain items are strictly forbidden on board:
- Glass containers
- Illegal materials
- Firearms or any form of weaponry
- Excess refreshments (beyond reasonable consumption allowance)
- Animals (except when pre-permitted)
6.3 Conduct
Patrons are expected to behave respectfully. We retain the right to halt a charter without a refund if a passenger's conduct endangers safety or hinders other guests' experiences.
7. Liability and Insurance
7.1 Our Liability
Our accountability is confined to the sum paid for your charter. We disclaim responsibility for:
- Personal harm caused by your own actions
- The loss or damage of personal items
- Indirect, consequential, or penal damages
- Delays due to weather or factors outside our control
7.2 Insurance Coverage
We hold comprehensive marine insurance that covers our boats and operations. It is recommended that passengers have their own travel and personal insurance policies.
7.3 Assumption of Risk
By engaging in our chartering services, you recognize that sailing activities carry inherent dangers and accept the responsibility for your own safety and welfare.
8. Modifications and Itinerary Changes
We maintain the right to alter itineraries, paths, or timetables due to weather, safety, or operational reasons. We will strive to offer comparable alternatives when possible.
9. Force Majeure
We cannot be held accountable for postponements, cancellations, or changes caused by forces beyond our management, including but not confined to:
- Extreme weather events
- Natural calamities
- Regulatory edicts
- Port shutdowns
- Mechanical failures
10. Privacy and Data Protection
Your private data is processed according to our Privacy Policy. Utilization of our services implies your assent to our data handling practices as detailed in the Privacy Policy.
11. Intellectual Property
Content on our website, like text, visuals, logos, and icons, is protected by copyright and trademark statutes. You may not reproduce, circulate, or produce derivatives without prior written consent from us.
12. Governing Law
These Terms are regulated by the laws effective in Spain. Any legal matters shall be handled in the courts located in Barcelona, Spain.
